The most common tort is negligence which is more specifically defined as a failure to use reasonable care to avoid foreseeable harm to another person. The damages can be the result of a motor vehicle accident or a slip or fall, and can range from a small whiplash to a catastrophic injury. Torts can be considered malicious or intentional and can include, for example, injuries sustained as a result of an assault or battery. They can also be considered to have strict or absolute liability -- meaning that the individual is responsible for your injuries regardless of negligence or intent.
